Terms & Conditions of Service

Serving South New Jersey, 30A Florida & Orlando, Florida

By booking childcare services, the Client agrees to the following Terms & Conditions.

1. Services Provided

Blue Harbor Babysitting Co. provides short-term, session-based childcare through W-2 employed, background-checked, CPR/First Aid–certified caregivers (“Sitters” or “First Mates™”).

Services may take place in private homes, vacation rentals, hotels, resorts, beaches, parks, or other Agency-approved locations. Sitters are not lifeguards.

The Agency retains sole discretion over sitter assignment, staffing levels, and safety determinations.

2. Booking & Payment

  • No payment is processed until a sitter is assigned.

  • Once confirmed, payment is charged in full to Blue Harbor Babysitting Co.

  • Families do not pay sitters directly.

3. Booking Timelines & Rush Fees

  • Bookings typically require at least 72 hours’ notice.

  • Requests made with 48 hours or less notice are considered rush bookings.

  • A non-refundable Rush Fee applies.

  • Rush bookings are subject to availability and not guaranteed.

4. Cancellation & Refund Policy

Because our caregivers are W-2 employees who reserve time and are scheduled for paid shifts, cancellation fees are based on how many hours before the session start time a booking is cancelled.

Client-Initiated Cancellations

  • 0–72 hours before start time:
    No refund

  • 73–168 hours (3–7 days):
    25% refund

  • 169–336 hours (8–14 days):
    50% refund

  • 337+ hours (15+ days):
    75% refund

Rush fees are non-refundable.
Once a sitter has been scheduled and payroll commitments are made, the session is considered earned.

5. Sitter Cancellations

If a sitter cancels due to illness or emergency:

  • The Agency will make reasonable efforts to provide a replacement.

  • If a replacement is available, the session proceeds as scheduled.

  • If no replacement is available, the Client will receive a full session credit for future use.

Credits have no cash value and are non-refundable.

6. Session Length, Late Returns & Overage Fees

  • Maximum session length is 10 hours (split shifts required beyond this).

  • Late care without prior approval is billed at $40/hour or double the standard hourly rate, whichever is higher.

7. Illness, Safety & Environment

Care cannot be provided if a child has had fever, vomiting, diarrhea, or a contagious illness within the past 24 hours.

Unsafe environments, undisclosed adults, pets, hazards, or refusal to follow safety guidance may result in immediate session termination with no refund.

8. Transportation & Water Activities

  • Sitters do not transport children or ride in Client vehicles.

  • Water and beach supervision is permitted only under Agency guidelines.

  • Sitters are not lifeguards.

​

9. Off-Platform Care Prohibited

Clients may not solicit, hire, or engage sitters outside the Agency platform. Violations may result in account termination and additional fees.

10. Governing Law & Disputes

New Jersey law applies to NJ services.
Florida law applies to FL services.
Multi-state disputes fall under Pennsylvania jurisdiction.

11. Acceptance of Terms

By booking a session, the Client confirms they have read and agree to these Terms & Conditions.
