Blue Harbor Babysitting Co. — Website Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of the websites, booking forms, chat portals, and related online services provided by Balia Referral Agency LLC d/b/a Blue Harbor Babysitting Co. (“Blue Harbor,” “we,” “us,” or “our”). By visiting our website(s) or booking services (collectively, the “Site”), you agree to these Terms and to our Privacy Policy.

If you do not agree, please do not use the Site.

1) Definitions

  • Client: A person or family who books childcare services through Blue Harbor.

  • Sitter: A W-2 employee of Blue Harbor who provides childcare services.

  • Booking: A confirmed childcare reservation for a specific date/time.

  • First Mate: Upgraded sessions for beach/pool/adventure care subject to added safety rules.

2) Eligibility; Territory

You must be at least 18 to book. Services are offered in New Jersey and Florida service areas, including homes, vacation rentals, hotels, and approved event venues. We may verify identities, hotel reservations, and other details before confirming a Booking.

3) Site Use; Accounts

You agree to provide accurate information, keep it current, and use the Site for lawful purposes only. You are responsible for all activity under your submissions or account (if applicable).

4) Service Overview (What We Do)

Blue Harbor provides short-term childcare by trained, background-checked W-2 employees. We are not a platform that connects you with independent contractors; Sitters are our employees supervised under our policies and safety protocols.

Important rules (summary):

  • No transportation: Sitters do not drive children and do not ride in family vehicles. Meet on-site.

  • Hotel care: Sitter meets in the hotel lobby and won’t enter rooms until a responsible adult is present.

  • First Mate (beach/pool/adventure) is available in NJ and applicable FL locations; ratios and safety rules apply.

  • Water: With Approved—Pool authorization, sitters may enter pools to supervise; ocean swimming is only in lifeguard zones; no deep-water activities.

  • Sunscreen: Parents acknowledge sitters may assist with parent-approved sunscreen using parent-provided products.

  • Incident reporting: Sitters report incidents to parents and Blue Harbor as soon as safely possible after children are secure.

  • Pets: Clients must disclose pets (type/breed/temperament) in advance. In emergencies, once children are safe, sitters may make reasonable efforts to remove pets from danger.

5) Booking, Assignment & Check-In/Out

  • Bookings should be submitted 72 hours in advance (weekends: 1 week).

  • Payment in full is required to confirm; no sitter assigned until paid.

  • Sitter assignments are based on availability/operational needs. No interviews/meet-and-greets; assignments aren’t changed for personal preferences.

  • Sitters clock in/out via our system; Client must sign out at session end. Social time after sign-out isn’t billable.

  • Client must disclose names of all persons present; unapproved guests may end the session.

6) Pricing, Fees & Taxes

Prices are listed on our Fee Schedule page and may change at any time. Taxes, premiums (e.g., holiday), and third-party fees (e.g., venue admission for sitters) may apply.

Reference — Effective 2025 (for convenience):

  • New Jersey: 4h $210 | 6h $295 | 8h $340 | Add-on hr $35 | First Mate +$25/+45/+55

  • Florida (all applicable locations): 4h $175 | 6h $295 | 8h $340 | Add-on hr $40 | First Mate +$35/+45/+55

  • Events/Weddings: Sitters $27/hr | Lead $30/hr | 5-hr min | Admin fee $250+ (in package); deposit non-refundable, balance due 2 weeks prior

  • Other: Holiday +$40; Late/Overage $35/hr NJ | $40/hr FL (hourly increments, no grace period); Multi-session discount $20 when 5+ sessions on one invoice; Family Share permitted (ratio limits apply)

If a posted price conflicts with the live Fee Schedule page, the Fee Schedule page controls.

7) Payments; Processors; Gratuities

You authorize us and our payment processors to charge your selected payment method for all amounts due. You represent you are authorized to use the method provided. Tips for Sitters are optional and at Client discretion unless required by venue policies.

Chargebacks and failed payments may incur admin fees and suspension of future bookings until resolved.

8) Cancellations, Refunds & Rescheduling

All locations (summary):

  • 30+ days: 75% refund (minus 2-hour admin fee)

  • 15–29 days: 50% refund (minus 2-hour admin fee)

  • 8–14 days: 25% refund (minus 2-hour admin fee)

  • 7 days or less: No refund

  • Within 7 days bookings: Non-refundable once confirmed

  • Events/Weddings: Deposit non-refundable; no refunds after sitter assignment

  • Agency Guarantee: If we cannot place a sitter for a confirmed Booking, 100% refund

  • Refunds apply to unused hours only; each session is a separate Booking

Weather: First Mate sessions may be converted to indoor/hybrid care at our discretion; if Client declines the alternative, no refund is provided.

Rescheduling is at our discretion and may involve fees.

9) Client Responsibilities (Safety Essentials)

You agree to:

  • Provide accurate medical info, emergency contacts, allergies, special needs.

  • Keep the location safe (e.g., pools fenced/secured, firearms locked, hazards out of reach, working smoke/CO detectors).

  • Provide all food, drinks, and child supplies; sitters do not bring unapproved snacks.

  • Disclose pets in advance; secure reactive animals before sitter arrival.

  • Be reachable during the session.

10) Conduct; Discipline; Reporting

  • Respect & Conduct: Zero tolerance for harassment, intimidation, threats, or unsafe behavior toward sitters (by adults or children).

  • Children’s conduct: Age-appropriate respect expected; share behavior needs in advance.

  • Discipline: No physical reprimands. Share preferred positive guidance strategies.

  • See Something, Say Something: Sitters report welfare/safety concerns to Blue Harbor; we may notify authorities as required.

We may terminate any session immediately for safety/conduct violations without refund.

11) Transportation & Secondary Locations

  • No driving/no riding: Sitters do not transport children and do not ride in Client vehicles.

  • Secondary locations (parks, restaurants, attractions): Pre-approval required; Client covers sitter admission/activity costs; meet on-site.

12) Hotel & Event Care

  • Provide hotel name, reservation number, and room info at Booking; we may verify.

  • Sitter meets in lobby; no room entry without a responsible adult present.

  • Events (incl. weddings) require 5-hour minimum; deposits are non-refundable; balance due 2 weeks prior.

13) Intellectual Property

The Site and all content are owned by Blue Harbor or its licensors and protected by law. You may not copy, modify, distribute, or create derivative works without our prior written consent.

14) Prohibited Uses

You agree not to misuse the Site, including by scraping, reverse engineering, interfering with security, posting unlawful content, or infringing intellectual property rights.

15) Privacy; Communications

Our Privacy Policy explains how we collect and use data. By using the Site, you consent to receive transactional communications (e.g., Booking confirmations, schedule changes).

16) Disclaimers

We strive for accurate information but do not warrant the Site will be uninterrupted, error-free, or that all information is current at all times. Except as expressly stated in our Family Agreement, services are provided under our safety protocols and subject to availability.

17) Limitation of Liability

To the maximum extent permitted by law, Blue Harbor and its owners, employees, and agents are not liable for indirect, incidental, consequential, special, or punitive damages, or for injuries arising from unsafe premises, undisclosed allergies/medical info, or violations of these Terms by the Client or third parties. Where liability cannot be disclaimed, it is limited to the amounts you paid for the relevant Booking(s) in the 6 months preceding the claim.

18) Indemnification

You agree to defend, indemnify, and hold harmless Blue Harbor and its personnel from claims, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site or violation of these Terms or applicable law.

19) Non-Solicitation

Clients agree not to solicit or hire Sitters outside of Blue Harbor for 12 months after the last session. Breach results in liquidated damages equal to the greater of $5,000 or the estimated annual wages of the Sitter, plus attorneys’ fees.

20) Insurance & Risk Allocation

Blue Harbor maintains General Liability, Workers’ Compensation, Professional Liability, and Sexual Abuse & Molestation (SAM) coverage. Any coverage for incidents allegedly involving sitter error/negligence is determined by our insurers. Clients must maintain a safe environment and secure valuables.

21) Governing Law; Dispute Resolution

These Terms are governed by the laws of the Commonwealth of Pennsylvania. Exclusive jurisdiction and venue lie in Pennsylvania state or federal courts. Mediation is required before filing suit. The prevailing party may recover reasonable attorneys’ fees and costs.

22) Changes to the Site or Terms

We may update the Site or these Terms at any time. Changes are effective when posted with an updated “Last Updated” date. Continued use after changes means you accept them.

23) General

If any provision is held invalid, the rest remain in effect. No waiver is effective unless in writing. You may not assign these Terms without our consent. These Terms (plus the Family Agreement & Fee Schedule and Privacy Policy) are the entire agreement regarding your Site use.
