(“Blue Harbor,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal information when you visit our websites, use our booking forms or chat portals, or receive our childcare services (together, the “Services”). By using the Services, you agree to this Policy and our Terms & Conditions.

We provide short-term childcare in New Jersey and Florida using trained, background-checked W-2 employees (“Sitters”).

2) What we collect

We collect information you provide directly, information we get automatically, and information from third parties.

A. Information you provide

  • Client & account info: name, email, phone, address, hotel/room details, booking history.

  • Child info (provided by parent/guardian): name, age, routines, allergies, medications, emergency contacts, swimming ability, and any special needs necessary for safe care.

  • Household info: people present during care, pets (type/breed/temperament), and location specifics (e.g., pool safety features).

  • Communications: messages you send via our private chat, emails, calls, incident reports.

  • Consents: water activities authorization, photo permission, policy acknowledgments.

  • Payment info: We use third-party processors; we do not store full card numbers.

B. Information collected automatically

  • Device/usage data: IP address, browser, device type, pages viewed, referring URLs, timestamps, and general location derived from IP.

  • Cookies/SDKs: for core functionality (e.g., session management), analytics, and preference storage. See Cookies below.

C. Information from third parties

  • Payment processors (payment status, last 4 digits, token data).

  • Scheduling/communication providers (message metadata, delivery info).

  • Hotel/venue verification (reservation confirmation where applicable).

  • Emergency services (incident records, as needed to ensure safety).

We do not knowingly collect information directly from children; all child data is provided by a parent/guardian.

3) How we use information

We use personal information to:

  • Provide and manage Services (bookings, sitter assignment, hotel/event verification, check-in/out).

  • Protect health and safety (follow emergency protocols; share necessary info with first responders if we call 911).

  • Communicate (confirmations, updates, incident reporting, support).

  • Process payments and prevent fraud.

  • Operate, analyze, and improve our Services (including analytics).

  • Comply with law and enforce our Terms (e.g., non-solicitation).

  • Marketing/updates about our Services (you can opt out at any time).

Photos: If you authorize in writing, sitters may take and share photos via our private chat solely for session updates; photos are deleted by sitters at session end. We will not use photos for marketing unless you sign a separate release.

4) How we share information

We share information only as needed to run our Services or as required by law:

  • Sitters (W-2 employees): limited access to booking details, child needs, and safety info for your session.

  • Service providers: payment processors, scheduling/chat platforms, website/IT, analytics. These vendors are bound to use your data only on our instructions.

  • Emergency services/authorities: when necessary to protect safety or comply with law (“see something, say something”).

  • Business transfers: as part of a merger, acquisition, or asset sale (your info will remain protected under this Policy or a successor policy).

  • Legal compliance: to respond to lawful requests, enforce our Terms, or protect rights/safety.

We do not sell personal information, and we do not share it for cross-context behavioral advertising (“targeted advertising”) as defined by U.S. state privacy laws.

5) Cookies & tracking

We use cookies and similar technologies to:

  • Keep you logged in and remember preferences.

  • Perform analytics to understand Site performance.

You can manage cookies through your browser settings. If we deploy a cookie banner, you can set preferences there. Do Not Track signals are not honored at this time due to industry standards variability.

6) Data retention

We keep personal information only as long as necessary for the purposes above and to comply with legal/insurance obligations. Examples:

  • Bookings, receipts, and incident reports: retained for our legal/insurance retention period ([e.g., 7 years]).

  • Chat/message history: retained for operational quality, dispute resolution, and safety ([e.g., 2–3 years]).

  • Photos: if authorized, deleted at session end by policy.
    Actual retention may vary based on legal holds or active disputes.

7) Security

We use administrative, technical, and physical safeguards designed to protect personal information (encryption in transit, access controls, employee training). No method of transmission or storage is 100% secure.

8) Children’s privacy

Our Services are arranged by adults for minors. We do not allow children to create accounts or submit data directly. Parents/guardians must provide accurate medical and emergency information. For any information collected from a child under 13 via a parent, we process it only to provide requested care, consistent with COPPA’s parental consent model.

9) Your privacy rights

Depending on your state (e.g., California, Virginia, Colorado, Connecticut, Utah), you may have rights to:

  • Know/Access the categories and specific pieces of personal information we hold.

  • Correct inaccuracies.

  • Delete personal information (subject to legal exceptions, e.g., safety/insurance records).

  • Portability (a copy in a portable format).

  • Opt-out of sale/sharing for targeted advertising (we do not sell/share).

  • Limit use of sensitive information (we use child health/safety info only to provide Services).

Non-discrimination: We will not discriminate against you for exercising your privacy rights.

10) International visitors

We are U.S.-based and process data in the United States. If you access our Services from outside the U.S., you consent to the transfer and processing of your information in the U.S., which may have different data protection laws than your country.
